David H. Baker has been practicing law in Washington, D.C. for 30 years, focusing on the areas of safety law and transportation law. He regularly represents clients before the U.S. Consumer Product Safety Commission, the Food and Drug Administration and the Department of Transportation. His clients include national trade associations, Fortune 500 corporations and privately held companies. Representative clients include the Asphalt Recycling and Reclaiming Association, the Asphalt Emulsion Manufacturers Association, the Juvenile Products Manufacturers Association, the Lighter Association, the Plastic Shipping Container Institute, the Tobacco Industry Testing Laboratory, the Writing Instrument Manufacturers Association, BIC, Coleman Company, Inc., The Colibri Group, Inc., The Holmes Group, Home Depot, Johanson Transportation Service, Office Depot, Plastican, Inc., Powermate Corporation, Sports Authority, Sunbeam Products, Inc., Toro Company, Tyco Fire & Safety, Zippo Manufacturing.
In the product safety area, Mr. Baker has been lead counsel for industry in five rulemakings before the CPSC and regularly represents clients before the CPSC in Section 15 reporting cases, recall actions and civil penalty proceedings. He also regularly appears before Health Canada/Sante Canada on behalf of manufacturers of regulated products in that country. In conjunction with an affiliate in Brussels, he also handles reporting issues and recalls in Europe under the General Product Safety Directive.
In the food and drug area, Mr. Baker provides assistance to U.S. companies and foreign establishments, that manufacture, import or distribute medical devices. He regularly assists companies with compliance with the medical device reporting requirements and acts as an agent for several foreign establishments.
In the transportation area, Mr. Baker has been counsel to numerous clients on exemptions and approvals before the Pipeline and Hazardous Materials Safety Administration, the Federal Motor Carrier Safety Administration, the Federal Highway Administration and the Federal Aviation Administration. He also has served as counsel for industry in several rulemakings before these agencies.
Mr. Baker previously served as the Executive Partner in the Washington, D.C. office of an AM LAW 50 law firm and on the Executive Committee of an AM LAW 200 law firm. In 2006, he decided to pursue a career goal of establishing his own firm focused on safety law.
